Terms & Conditions

1. Agreement to Terms

These Terms & Conditions constitute a legally binding agreement between you (whether individually or representing an organization) and HYKTEC ("Company", "we", "us", or "our"), governing access to and use of hyktec.com as well as all engineering services, client portals, and applications provided.

2. Scope of Services & SOWs

HYKTEC provides software development, mobile application engineering, AI automation solutions, and technical advisory services. Specific deliverables, milestone schedules, and costs are agreed upon in written Statements of Work (SOW) or project proposals.

3. Intellectual Property Rights

• Client Work Product: Upon 100% receipt of payment for the agreed milestones or final project invoice, all custom source code, documentation, and digital assets crafted exclusively for the client are assigned to the client.
• Pre-existing Assets & Libraries: Open-source frameworks (e.g. Next.js, React, Tailwind) and HYKTEC proprietary internal utility modules remain subject to their respective licenses.
• HYKTEC Platform & Branding: The HYKTEC trademarks, logos, website design, and proprietary internal tools are exclusive property of HYKTEC.

4. Payment Terms & Invoicing

Invoices are issued based on milestone approvals as specified in individual contracts. Payments are due within the timeframe indicated on the invoice (typically net-7 or net-14 days). Delinquent accounts may result in temporary suspension of active engineering deployments or portal access.

5. Client Obligations

Clients agree to supply timely feedback, API keys, content materials, and domain credentials necessary to meet agreed timelines. Failure to provide essential prerequisites may cause project schedule revisions.

6. Warranties & Limitation of Liability

We warrant that deliverables conform to the agreed written specifications at the time of delivery. HYKTEC provides a 30-day bug-fix warranty on custom deliverables following milestone sign-off. Except where prohibited by law, HYKTEC will not be liable for indirect, punitive, or consequential damages resulting from third-party server downtimes or external API deprecations.

7. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of India. Any legal action or dispute arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Jamui, Bihar, India.
